A BILL to amend article five, chapter six of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section thirteen,
relating to disqualification of persons appointed or elected
to full-time public offices who hold other elected full-time
or part-time public offices.
Be it enacted by the Legislature of West Virginia:
That article five, chapter six of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new section, designated section thirteen, to read
as follows:
ARTICLE 5. TERMS OF OFFICE; MATTERS AFFECTING THE RIGHT TO HOLD
OFFICE.
§6-5-13. Disqualification by holding full or part-time elected
public office.





Any person who holds a full-time or part-time elected public
office in this state, may not be elected or appointed to any other
full-time office under the laws of this state; and, if any person,
while holding a full-time or part-time elected public office, is
elected or appointed to any other full-time public office, that
person must vacate the prior full-time or part-time elected office.





NOTE: The purpose of this bill is to prohibit persons holding
full-time or part-time elected public offices in this state from
being appointed to, or being elected to, any other full-time public
office unless the previous office is vacated by that person.
